Introduction
The Malaysia Competition Commission (‘MyCC’) is an independent body established under the Competition Commission Act 2010 to enforce the Competition Act 2010. The main role of MyCC is to protect the competitive process, benefiting businesses, consumers and the economy.
The main function of MyCC is to carry out functions under the Competition Act 2010, issue guidelines, act as an advocate for competition matters, carry out general studies in relation to issues on competition within the Malaysian economy as well as informing and educating the public regarding the ways in which competition may benefit consumers and the economy of Malaysia as a whole. The MyCC can conduct investigations into any alleged infringement based on complaints, direction of the Minister or on their own initiative.
The Guidelines
Pursuant to s 66 of the Competition Act 2010, MyCC has the power to issue guidelines for the better carrying out of the provisions of the Competition Act 2010. These guidelines provide guidance on economic and legal analysis to be used in determining cases and principles to be used in determining any penalty or remedy imposed under the Competition Act.
To date, there have been seven guidelines issued by MyCC as follows:
- The MYCC Guidelines on Intellectual Property Rights and Competition Law;
- Guidelines on Anti-Competitive Agreements;
- Guidelines on Abuse of Dominant Position;
- Guidelines on Complaints Procedures;
- Guidelines on Market Definition;
- Guidelines on Financial penalties; and
- Guidelines on Leniency Regime.
